Stratis pallets and containers are warranted to be free of defects in material and workmanship, so long as such pallets and containers are not subjected to misuse or improper handling. This warranty will extend for a period of one year from the date of delivery. All Stratis pallets and containers deemed by Stratis Corporation to be defective will be replaced at no cost to the customer, provided the unsatisfactory pallets or containers are returned to Stratis Corporation. THE FOREGOING WARRANTY IS IN LIEU OF AND EXCLUDES ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Stratis Corporation's liability for breech of the foregoing warranty shall be limited to replacement of the unsatisfactory pallets or containers. In no event shall Stratis Corporation be liable for incidental or consequential damages of any sort.
Stratis Plastic Pallets and containers are sold with the understanding that the customer will test them under actual conditions of use and be solely responsible to determine the suitability of the pallets or containers for their intended use. Reasonable variation in product characteristics may be expected due to normal manufacturing tolerances. Because of the variety of possible uses for the pallets and containers, customer should carefully consider fitness and performance of pallets and containers for each intended use, and customer assumes all risks in connection with such determination and use.
